This part contains binding health and liability statements for BiNeural.ai use. Please read carefully.

1.1. Medical & Health Disclaimer

No medical-device, diagnostic or treatment character: EMDR bilateral sound modulation, binaural rhythms and conversion tools on BiNeural.ai are in no way a medical device, clinical treatment, psychotherapy, counselling or medical diagnosis. Content and features are digital tools for personal meditation, focus aid and general relaxation only.

Epilepsy and neurological conditions warning: rhythmic sound oscillations (LFO) and frequency modulations may trigger adverse biological reactions in neurologically sensitive people. People with epilepsy, past brain trauma, pacemakers, or neurological/psychiatric conditions described in the medical literature must consult a qualified physician before using these tools.

Attention-demanding activities and driving: BiNeural sound modulations may relax you or shift focus. Never listen to sounds produced here while driving motor vehicles, operating heavy/dangerous machinery, or during any high-attention work.

Not medical advice: nothing on this site replaces a professional doctor or mental-health specialist. Never delay or stop existing treatment for a health condition because of this site.

1.2. Copyright & Intellectual Property Statement

You are solely responsible for the legality of the audio you upload; the binding text is quoted verbatim below:

The User accepts, declares and undertakes that they fully hold the ownership rights, copyrights, valid licences or lawful personal-use permissions for all audio files (MP3, WAV, FLAC, M4A, etc.) uploaded, processed or converted on the BiNeural.ai platform. BiNeural.ai is not obliged to verify the legal status of user-provided content. As all audio processing takes place entirely on the user’s own device and in browser memory (client-side), no content is transmitted to or stored on platform servers. Accordingly, any legal, criminal or financial liability arising from uploaded audio infringing Law No. 5846 on Intellectual and Artistic Works (FSEK), international copyright treaties (DMCA, etc.) or third-party intellectual property rights rests exclusively and entirely with the user. The user unconditionally agrees to indemnify BiNeural.ai, its administrators and affiliates against any third-party claims, damages, court costs and attorney fees arising from direct or indirect infringement.

1.3. No Warranty (“As-Is”)

All software tools, algorithms and services on BiNeural.ai are provided “as is” and “as available”. The platform gives no express or implied warranty of uninterrupted operation, fitness for purpose, error-free functioning or flawless output quality.

PART 2 — Terms of Service

The articles below govern use of the Platform.

2.1. Parties and Acceptance

This Terms of Service Agreement (“Agreement”) is concluded between the BiNeural.ai website (“Platform”) management and all natural and legal persons (“User”) who visit, access or use its audio tools. By starting to use the site you declare that you have read, understood and accepted these terms in full.

2.2. Nature of Service and Technical Architecture

Client-side processing: the Platform uses browser-based Web Audio API technology. Uploaded audio is processed only on your own device (RAM/browser memory).

No server storage: no audio file, converted data or personal media is transmitted to, stored on, copied by or shared from BiNeural.ai servers. The Platform is merely an interface serving client-side code.

2.3. User Rights, Obligations and Declarations

1) Legal age and capacity: the User declares they have the legal majority and capacity required by their national laws to conclude this agreement.

2) Lawful use: the User will use the Platform for lawful purposes only and will not attempt to threaten its security, reverse-engineer it or harm server infrastructure.

3) IP responsibility: a User commercially distributing converted audio is personally responsible for obtaining the necessary licences. BiNeural.ai acts only as a neutral software utility.

2.4. No Medical Claims and Assumption of Risk

The User accepts that they assume all neurological, psychological and physical risks of using the sound-modulation tools of their own free will. No rights or compensation may be claimed from the BiNeural.ai platform or its developers for dizziness, nausea, distraction, epileptic seizures or psychological discomfort.

2.5. Limitation of Liability

To the maximum extent permitted by applicable law, BiNeural.ai, its owners, developers and staff cannot be held liable for direct, indirect, incidental, punitive or consequential damages from use or inability to use the Platform; for data loss, device failures or software conflicts during processing; or for third-party fines and lawsuits arising from user copyright infringement.

2.6. Third-Party Links and Advertising

The Platform may contain links and banners from Google AdSense or other ad networks. BiNeural.ai does not review ad content, linked sites’ privacy policies or product reliability, and accepts no responsibility. Your relationship with advertisers binds only you.

2.7. Service Changes and Termination

BiNeural.ai reserves the right to change how the Platform works, update, restrict or fully terminate the service without prior notice. Updated terms take effect upon publication on the site.

2.8. Governing Law and Jurisdiction

All disputes arising from the application or interpretation of this Agreement and from use of the Platform are governed by the Law of the Republic of Türkiye. The Istanbul (Çağlayan) Courts and Enforcement Offices have exclusive jurisdiction.
